Terms and Conditions
Effective July 29, 2026These terms govern your access to the Gear6 website and design-partner program.
1. Acceptance of these terms
These Terms and Conditions are a binding agreement between you and Gear6, Inc. (“Gear6,” “we,” “us,” or “our”). By accessing or using this website, applying to the design-partner program, or otherwise interacting with a feature that links to these terms, you agree to these terms and our Privacy Policy. If you do not agree, do not use the site.
If you use the site on behalf of a company or other organization, you represent that you have authority to bind that organization, and “you” includes that organization.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the site or apply to the design-partner program. The site is intended for business and professional use and is not directed to children.
3. The website and design-partner program
The website provides information about Gear6 and lets eligible users apply to become a design partner. Applying does not create a customer relationship or guarantee acceptance. Accepted design partners are eligible for the six-month free offer described on the site; program timing and access details will be shared during onboarding.
Product visuals, examples, roadmaps, and descriptions may be illustrative or forward-looking. Features may change, be delayed, or never become available.
4. Application information and communications
You agree to provide accurate information and not impersonate another person or organization. By applying, you ask us to send design-partner and related product communications to the email address you provide. You may unsubscribe from marketing messages at any time. We may still send non-marketing messages when permitted by law.
5. Acceptable use
You may not:
- use the site for an unlawful, fraudulent, or harmful purpose;
- interfere with, disrupt, overload, or attempt to bypass the site’s security or access controls;
- use automated means to scrape, crawl, or extract site content except as permitted by our robots instructions or written authorization;
- introduce malware, attempt unauthorized access, or probe for vulnerabilities without written permission;
- misrepresent your identity, affiliation, or authority; or
- copy, modify, distribute, sell, or create derivative works from the site except as allowed by law or written permission.
6. Ownership
The site, including its software, design, text, graphics, logos, product visuals, and other content, is owned by Gear6 or its licensors and is protected by intellectual-property laws. Subject to these terms, Gear6 grants you a limited, revocable, non-exclusive, non-transferable license to access and use the site for its intended informational purpose.
Company and product names displayed on the site may be trademarks of their respective owners. Their appearance does not imply sponsorship or endorsement.
7. Feedback
If you provide ideas, suggestions, or other feedback about Gear6, you grant us a worldwide, perpetual, irrevocable, royalty-free, transferable, and sublicensable right to use and commercialize that feedback without restriction or compensation. This does not give us ownership of your confidential information or personal information.
8. Third-party services and links
The site may refer or link to third-party products, websites, or services. Gear6 does not control and is not responsible for those third parties, their content, availability, security, or practices. Your use of a third-party service is governed by its own terms and policies.
9. Disclaimers
To the maximum extent permitted by law, the site and all content are provided “as is” and “as available.” Gear6 disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted or error-free operation.
Nothing on the site is legal, financial, employment, security, or professional advice. You are responsible for evaluating information before relying on it.
10. Limitation of liability
To the maximum extent permitted by law, Gear6 and its affiliates, officers, directors, employees, agents, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business opportunities, arising from or related to the site or these terms, even if advised that such damages were possible.
To the maximum extent permitted by law, the total liability of Gear6 and the other Gear6 parties for all claims arising from or related to the site or these terms will not exceed the greater of $100 or the amount you paid Gear6 to use the site during the 12 months before the event giving rise to the claim.
Some jurisdictions do not allow certain disclaimers or limitations, so some of the above may not apply to you. In those jurisdictions, liability is limited to the fullest extent permitted by law.
11. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless Gear6 and its affiliates, officers, directors, employees, and agents from claims, damages, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from your unlawful use of the site, your violation of these terms, or your infringement of another person’s rights.
12. Suspension and termination
We may suspend or terminate your access to the site at any time if we reasonably believe you violated these terms, created risk for Gear6 or others, or if we discontinue the site. Sections that by their nature should survive termination will survive, including ownership, feedback, disclaimers, limitations, indemnification, and general provisions.
13. Governing law and venue
These terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. Any dispute arising from or related to the site or these terms must be brought exclusively in the state courts located in New Castle County, Delaware, or the United States District Court for the District of Delaware. You and Gear6 consent to personal jurisdiction and venue in those courts.
14. Changes to these terms
We may update these terms as the site changes. We will post the revised terms here and update the effective date. Changes apply prospectively when posted unless we provide a different date or applicable law requires additional notice. Your continued use after the effective date means you accept the revised terms.
15. General provisions
These terms and the Privacy Policy are the entire agreement between you and Gear6 regarding the public site. If a provision is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will stay in effect. A waiver must be in writing and is not a continuing waiver. You may not assign these terms without our consent. We may assign them in connection with a reorganization, financing, merger, acquisition, or sale of assets. Headings are for convenience only.
